This website is owned and operated by Adaia. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors access to purchasing and processing Adaia products. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

In order to use our website and/or receive our services, you must be at least 16+ years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for buying our products are listed on the website. Adaia reserves the right to change prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. 
 

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of the owner of this website, Adaia. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

You recognise and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

​Adaia reserves the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotions & Discounts

Promotional sales may exclude selected styles and the purchase of Gift Cards. All styles will be marked down if included in a promotion unless a discount code is required, in which case the final price will display once the code has been entered correctly at checkout. Only one discount code can be applied to an order. Discount codes must be entered at checkout and cannot be redeemed after this point. Adaia reserves the right to change or end a promotion at any time without notice.

 

Order Processing 

Orders are processed on business days (Monday through Friday) excluding public holidays in New South Wales, Australia.

​Change of Mind (Returns)

In accordance with Australian Consumer Law, we are not required to offer you a refund for sizing, fit, change of mind, or returns. For example, the consumer guarantees do not apply if you got what you asked for but simply changed your mind, found it cheaper somewhere else, decided you did not like the purchase or had no use for it.

When you have a problem with a product on delivery, you have the right to ask for your choice of a replacement, store credit, or refund. If we have misrepresented the product or provided an incorrect description, you have the right to ask for your choice of a replacement product, a store credit, or refund.

Payment & Purchasing Details

Customers must provide Adaia with complete and accurate details when making purchases. Adaia is not liable if we are given an incorrect delivery address at the time of purchase or returned goods. Any additional expenses in correcting the order are the responsibility of the customer.

All of our prices are in AUD, Adaia is not responsible for varying currency conversion rates charged by customers’ banks.

Customers will receive an invoice confirming the order once Adaia receives payment either through Credit Card, PayPal or Afterpay.

Payment or debiting of your credit/debit card will be completed when you accept to complete the transaction at checkout. Adaia uses the Stripe Payments Gateway for all online credit card transactions. Stripe Payments is a PCI-DSS Certified Gateway. Your credit card number cannot be viewed by Adaia or any third party.

We take a firm stance against credit card fraud. If your transaction is flagged in our system or suspected fraud, we will check your order by phoning you on the given number or email to ensure that the purchase has been made by the credit card holder. If we find anyone trying to use another person's details, Adaia will report all transaction information to the Australian Federal Police and banking authorities.

Order Cancellation 

After placing an order you will receive an email receipt confirming the details of your purchase. This email receipt does not comprise a contract.

Orders may be cancelled at any time due to an inability to authorise a payment, insufficient stock, suspicion of fraudulent intent or any other reason deemed appropriate by Adaia. In addition, Adaia reserves the right to decline or cancel any such orders.

Instagram Giveaways 

Any competition or giveaway promoted by Adaia is in no way sponsored, endorsed or administered by, or associated with Instagram, Inc. By entering, entrants confirm they are 16+ years of age, release Instagram of responsibility and agree to Instagram's terms of use. Winners will be contacted via DM on Instagram and if applicable will also be announced in the caption of the original post on Adaia account. Prize fulfilment is subject to availability and may differ from promotional images and information. Adaia reserves the right to substitute a prize of equal or greater value for the prize in its sole discretion, unless such substitution is prohibited by law. Prizes are non-transferable and Adaia need not substitute a prize based on a winner’s request.
